Acceptable Use Policy
This Acceptable Use Policy (this "AUP") is incorporated by reference into the Master Service Agreement between 2 Acre Studios (d/b/a 2 Acre AI) ("Provider") and the customer identified in the Order Form ("Customer").
This AUP describes prohibited uses of the Services. Customer is responsible for the acts and omissions of its Authorized Users, and a violation of this AUP by an Authorized User is a violation by Customer.
1. Prohibited content and conduct
Customer shall not use the Services to:
(a) Send or solicit unsolicited bulk SMS, telemarketing calls, or any communication prohibited by the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, or similar state laws
(b) Engage in deceptive, fraudulent, or misleading practices, including impersonating any person or business that Customer is not authorized to represent
(c) Process or solicit information from minors under 13 in violation of the Children's Online Privacy Protection Act (COPPA)
(d) Process Personal Information about individuals from whom Customer has not lawfully obtained that information
(e) Distribute or transmit malicious code, viruses, or other harmful software through the Services
(f) Attempt to gain unauthorized access to the Services, Provider's infrastructure, or any third-party system
(g) Reverse engineer, decompile, or extract the underlying models, prompts, or proprietary configurations of the Services
(h) Resell, sublicense, or provide the Services to third parties without Provider's prior written authorization
(i) Use the Services in any manner that could damage Provider's reputation or the goodwill associated with the Services
(j) Use the Services to harass, threaten, defame, or stalk any individual
(k) Engage in activities that violate any applicable law, regulation, or industry rule, including (without limitation) consumer-protection laws and trade-practices laws
2. Telephony-specific compliance
2.1 Recording disclosure
Pennsylvania is a two-party-consent state. Customer must keep the recording-disclosure announcement enabled at all times when the Services are operating in Pennsylvania or in any other two-party-consent jurisdiction. Customer is responsible for compliance with recording-consent laws in any jurisdiction where the receptionist answers calls.
2.2 A2P 10DLC
For outbound SMS (review requests, booking confirmations, owner alerts), Customer must complete A2P 10DLC registration through Provider's onboarding flow before live SMS is enabled. Customer must accurately describe its messaging use case and not exceed the registered throughput limits.
2.3 Do-Not-Call lists
Customer must respect the National Do-Not-Call Registry, the Do-Not-Call requests of individual customers, and any internal opt-out lists Customer maintains. The Services include unsubscribe mechanics for outbound SMS; Customer must not disable them.
2.4 No autodialed sales calls
The Services are designed for inbound call handling. Customer shall not attempt to use the Services for autodialed outbound sales calls unless explicitly enabled by Provider as a paid add-on and registered for that purpose.
3. Industry restrictions
The Services are designed for use by HVAC contractors and other building trades. Customer shall not use the Services in connection with any of the following without Provider's prior written authorization:
- Healthcare-regulated activities subject to HIPAA (we do not have a Business Associate Agreement and the Services are not HIPAA-compliant)
- Financial services subject to GLBA or PCI-DSS scope (we are not a regulated entity)
- Adult content
- Gambling, including sports betting and online casinos
- Cannabis sales (varies by state; check state-specific advertising rules)
- Cryptocurrency or digital-asset trading platforms
- Multi-level marketing
- Debt collection (subject to FDCPA)
- Political fundraising
4. Fair use
The Services include 500 inbound call minutes per month and unlimited outbound SMS for review requests and booking confirmations. "Unlimited" is subject to fair-use principles. Provider reserves the right to investigate and, if necessary, throttle, suspend, or charge overage for usage that materially exceeds the volume profile of comparable HVAC contractor customers (e.g., 10,000+ outbound SMS per month for a single shop without a corresponding customer base).
5. Reporting violations
If you become aware of an actual or suspected violation of this AUP, please report it to [email protected] with as much detail as you can provide. Provider investigates all reports.
6. Consequences of violation
If Provider determines, in its reasonable discretion, that Customer has violated this AUP, Provider may:
(a) Provide written notice of the violation and an opportunity to cure (where practicable)
(b) Suspend access to the Services pending investigation or cure
(c) Terminate the Master Service Agreement for cause without further notice if the violation is severe or repeated
(d) Cooperate with law-enforcement authorities to the extent required by law
In addition, Customer agrees to indemnify Provider against any third-party claims arising from Customer's violation of this AUP, in accordance with Section 10 of the Master Service Agreement.
7. Updates
Provider may update this AUP from time to time. The "Last updated" date at the top will reflect the latest version. Material changes will be communicated by email to active Customers. Continued use of the Services after a change becomes effective constitutes acceptance of the updated AUP.
