These Terms of Service (these "Terms") govern your use of the website 2acreai.com (the "Site") and any informational materials made available on the Site. The Site is operated by 2 Acre Studios (d/b/a 2 Acre AI), a Pennsylvania sole proprietorship of Marc Shade ("we," "us," "our").
These Terms apply to your use of the Site itself. The contractual terms governing paying customers' use of the AI voice receptionist services are set forth in the Master Service Agreement (the "MSA") at https://2acreai.com/legal/msa, not in these Terms.
By accessing or using the Site, you agree to these Terms and the Privacy Policy at https://2acreai.com/privacy/. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old and have the legal authority to bind yourself or, if applicable, the business you represent. The Site is intended for businesses, primarily HVAC contractors in the United States.
2. Permitted use
You may use the Site only for lawful purposes and in accordance with these Terms. You may not:
- Use the Site in a manner that could damage, disable, overburden, or impair our infrastructure
- Attempt to gain unauthorized access to any portion of the Site, our APIs, or any related systems
- Use any robot, scraper, or other automated means to access the Site for any purpose without our express written permission, except for well-behaved search-engine crawlers and the AI crawlers we explicitly allow in our
robots.txt - Use the Site to transmit any unsolicited communications, viruses, or malicious code
- Reverse engineer, decompile, or disassemble any portion of the Site
- Frame the Site or use any meta tags or other hidden text or metadata that uses our name or trademarks without express written consent
3. Intellectual property
The Site, including all text, images, video, audio, layout, design, source code, and trademarks, is owned by us or our licensors and is protected by United States and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access the Site solely for your personal or internal business evaluation use.
You may share links to the Site freely. You may quote brief excerpts of Site content with attribution.
4. User submissions
If you submit any information through the Site (e.g., the missed-call calculator at /assessment, the signup form at /signup, or any contact form), you represent that the information is accurate and that you have the right to submit it. We may use submitted information in accordance with our Privacy Policy.
5. Third-party links
The Site may contain links to third-party websites. We do not endorse and are not responsible for the content, policies, or practices of any third-party site.
6. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
The numbers shown by the missed-call calculator are estimates based on industry benchmarks. They are not guarantees, projections, or financial advice. Your actual results will vary based on factors specific to your business.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100.00).
This Section 7 does not apply to liability that cannot be limited under applicable law. Paying customers' rights under the MSA are governed by the MSA's separate liability terms.
8. Governing law and venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. The exclusive venue for any dispute arising out of or related to these Terms is the state and federal courts located in Allegheny County, Pennsylvania, and you consent to the personal jurisdiction of those courts.
9. Changes
We may update these Terms from time to time. The "Effective Date" at the top will reflect the latest version. Continued use of the Site after a change becomes effective constitutes acceptance of the updated Terms.
